The San Francisco Chronicle is reporting that Chief U.S. District Judge Vaughn Walker will decide tomorrow whether the controversial Prop 8 initiative in November 2008 that outlawed same-sex marriage violated the rights of gay men and lesbians under the U.S. Constitution.

A non-jury trial was held in January, the first time a same-sex marriage case was heard in federal court.

The decision is expected to come between 4 p.m.-7 p.m. Eastern Time.

Atlanta’s Queer Justice League is organizing a gathering at 6:30 p.m. at 10th Street and Piedmont Avenue at 7 p.m. on Wednesday to come together as community to either celebrate or protest the California decision. Other LGBT groups are welcome to attend.

The QJL, Georgia Equality and MEGA Family Project are also planning a rally and counter protest to the National Organization for Marriage’s stop in Atlanta on Saturday as part of its “Summer Marriage Tour 2010.”
