Federal Court Rules in Favor of Trans-Inclusive Bathroom Policy in Pennsylvania

The U.S. Court of Appeals for the Third Circuit made a unanimous decision upholding Boyertown Area School District’s LGBTQ-inclusive school policy. This came after the notoriously anti-LGBTQ Alliance Defending Freedom (ADF) filed a lawsuit against the Boyertown Area School District for their inclusive school policy that permitted trans students access to bathrooms and locker rooms that match their gender identity. After ADF’s request was denied in August, the case went to the U.S. Court of Appeals for the Third Circuit. That ruling was upheld today.

The news comes days after a federal judge from Virginia ruled in favor of Gavin Grimm, a transgender boy who suffered similar discrimination at his high school.

Said the Human Rights Campaign Legal Director Sarah Warbelow moments after the ruling:

“As the Trump-Pence Administration and anti-equality activists continue to attack our school children, federal courts nationwide are reaffirming the legal rights and dignity of transgender people. School should be a safe space for all youth, and we commend the Boyertown Area School District for not only implementing an LGBTQ-inclusive policy, but for fighting to protect their most vulnerable and marginalized students.”
